New Governance and Social Europe:

Theory and Practice of Minimum Harmonization and Soft Law in the Multilevel System

This project analyzes new forms of governance and the characteristics of social institution-building in the European multilevel system. The specific focus is recent EC social policy which has been characterized by a flexible style of regulation based on minimum standards, possibilities for derogations and non-binding recommendations.

We aim to assess the impact of this development in terms of the substantive effects of EC labour law in the fifteen Member States. Do the European Directives adopted in the 1990s in the face of increased economic competition allow for the maintenance or improvement of existing levels of social protection? What is the practical effect in the different member states of autonomy and flexibility granted in EC standards? The answers promise to be of interest not only in empirical but also in theoretical terms, since existing approaches differ widely in their assessments of the problem-solving capacity of the EU.

The envisaged book publication will study in depth the quantitative and qualitative development of EC social policy over time and discuss which forms of social policy governance are most promising in the light of regime competition.
